Trademark Registration Process in Bhutan (As Per Official Procedure)
The trademark registration process begins with the filing of an application on Form 7 with the Registrar of Industrial Property. The application must include a clear reproduction of the mark, applicant details, and a list of goods or services classified under the Nice Classification. Upon receipt, the Registrar accords a filing date once minimum filing requirements and fees are satisfied.


Following filing, the Registrar conducts a formal and substantive examination to determine whether the mark qualifies as a registrable mark under Sections 24 and 25 of the Act. This examination assesses distinctiveness, legality, and potential conflicts with existing or earlier-filed marks.


If the application is accepted, it is published in the Official IP Bulletin, triggering a three-month opposition period. During this period, any interested party may file a notice of opposition. If opposition is filed, the Registrar conducts opposition proceedings, including counter-statements, evidence submission, and hearings where necessary.


Where no opposition is filed—or where opposition is resolved in favor of the applicant—the Registrar registers the mark, publishes a reference to registration, and issues a Certificate of Registration. The trademark is then entered into the Register of Marks and becomes enforceable throughout Bhutan.
